Contested Divorce in Fort Lauderdale
A contested divorce is one where you and your spouse cannot agree, whether the disagreement is about custody and time-sharing, the division of property, support, or all of it at once. It can be one of the hardest legal processes a person goes through, and it rarely gets easier on its own. Working with a Fort Lauderdale contested divorce lawyer who is a board certified family law attorney in Boca Raton, Board Certified in Marital and Family Law by The Florida Bar, can help protect your rights and your future when the other side is not being reasonable.
Most people in the middle of a contested divorce are dealing with the legal complexity and the emotional weight at the same time. Knowing what to expect, what the court will actually weigh, and what your real options are makes a meaningful difference. It is important to have a Fort Lauderdale divorce attorney with the experience to litigate when the case calls for it, and the judgment to settle when settling is the right move. Contested Divorce Representation in Broward County
Tina L. Lewert is Board Certified in Marital and Family Law by The Florida Bar, a designation only a small percentage of Florida family lawyers hold. She has the experience, the courtroom skill, and the in-depth knowledge of Florida law to handle contested divorces from temporary relief through final judgment. Ms. Lewert is also a Florida Supreme Court Certified Family Law Mediator and is Nationally Board Certified in Family Trial Law by the National Board of Trial Advocacy, which is the credential that recognizes trial preparation and courtroom advocacy at a national level.
Our approach is straightforward. Wherever it serves your interests, we work to resolve matters through structured negotiation and mediation, because it is usually faster, less costly, and less damaging to the people involved, especially when children are part of the picture. When the other side will not be reasonable, or when what is fair is on the line, Ms. Lewert is fully prepared to litigate assertively in court.
For Fort Lauderdale clients, the local court reality matters. Broward County family files are heard through the 17th Judicial Circuit of Florida, which operates a Unified Family Court structure, with the central courthouse located at the Broward County Judicial Complex at 201 SE 6th Street in downtown Fort Lauderdale. General magistrates handle many of the procedural and temporary matters before a judge takes the contested issues to trial. Knowing how the local judges and magistrates have historically handled contested custody, temporary support, and complex evidentiary issues changes the strategic calculus in a contested case.
Lewert Law handles a variety of contested divorce matters, including:
- Contested custody and time-sharing disputes
- Contested equitable distribution and asset division
- Contested alimony and support cases
- Temporary relief hearings
- Trial preparation and representation
- High-conflict cases involving safety concerns
- Contested cases involving business or complex assets
- Contested relocation cases
- Post-judgment contested modifications

Fort Lauderdale Contested Divorce: Common Questions
What makes a divorce "contested" in Florida?
A divorce is contested when you and your spouse cannot agree on one or more of the issues the court has to resolve. Those issues typically include the division of marital property and debts, alimony, parental responsibility, time-sharing schedules, and child support. A divorce can be contested on a single issue while the rest of the case is uncontested, and the level of conflict can change as the case progresses. The opposite is an uncontested divorce, where both spouses agree on every issue and the court mostly approves the agreement.
How long does a contested divorce take in Florida?
It depends on how many issues are contested, how complex they are, and how the case moves through the local court schedule. A contested divorce can take anywhere from several months to over a year, sometimes longer in particularly complex or high-conflict cases. The timeline is also shaped by whether the case settles at mediation or has to go to trial. Florida requires a 20-day waiting period between filing and the court entering a final judgment, but contested cases almost always take much longer than that.
Can a contested divorce still settle without going to trial?
Yes, and most contested divorces do. Florida courts in Broward County and elsewhere generally require the parties to attempt mediation before a contested case goes to trial. Mediation often resolves issues that seemed stuck in litigation, partly because the parties have more control over the outcome than they would at trial, and partly because by the time mediation happens, both sides usually have a clearer picture of the case. Even when full settlement is not possible, mediation often narrows the issues that have to be tried.
What happens at a temporary relief hearing?
Temporary relief hearings address the immediate practical issues that cannot wait until final judgment. The court can set a temporary time-sharing schedule, order temporary child support and temporary alimony, allocate use of the marital home, and address other interim matters. The decisions made at temporary relief often shape the rest of the case, both practically and because they create a status quo the court may be reluctant to disturb later, so the preparation that goes into these hearings matters.
How does the court decide custody when parents do not agree?
Florida law uses the term "parental responsibility" rather than "custody," and the court is required to consider the best interests of the child, weighing the factors listed in Florida Statute 61.13. Those factors include each parent's ability to provide a stable environment, the child's relationship with each parent, the moral fitness of each parent, the geographic viability of any proposed time-sharing schedule, and many others. Florida also has a rebuttable presumption that equal time-sharing is in the best interests of the child, which a parent must specifically rebut with evidence if they are seeking a different arrangement.
How much does a contested divorce cost?
A contested divorce typically costs more than an uncontested one, because the work is more involved: temporary relief hearings, discovery, depositions, expert witnesses where applicable, and trial preparation all add real cost. The exact range depends on how many issues are contested, how cooperative the other side is, and whether the case settles or goes to trial. The confidential consultation is the right place to discuss cost openly, so you can make an informed decision about how to proceed.

Tina helped me win a relocation case against “the giant”. A case many insisted was a waste of time because I would never win. Tina is up to date on current statues and case law which lists out certain objectives a relocation must meet in order to be granted. I am amazed by her intelligence and ability to interpret law and break it down to me in an elementary manner. Throughout the case, she was always detail oriented, eloquent, ethical and most of all, Tina possesses a sixth sense of what facts to focus on, what is important for the case. She adequately prepared me and herself for each trial day. I can not say enough praise about this amazing lawyer, hopefully I’ll never need her again, but I wouldn’t complain if I do. Tina and her assistant Sharon treated me like family. They were the light during the worst part of my life. I don’t want to share too much about her strategies but this woman is AMAZING at cross examination. She came up with angles I would have never dreamed of. It’s important to trust Tina, she won’t steer you wrong. Don’t forget, while she fights hard for you, it is also important for you to be diligent as well.

I hired Tina Lewert to represent me in my contentious divorce. I had consulted with several other highly rated divorce lawyers in Boca and she just outshined the others from the moment we first spoke. Highly recommend this lawyer to handle your divorce - don't fall for the others who talk a big talk and try to scare you to stir up the drama which stirs up their fees too. Tina was always honest with me about what I could expect, about the law, and the pros and cons, and she explained the law and how it applied to my case better to me than 3 other [supposedly excellent] lawyers combined. She knows what she's doing but she's not pompous about it and she's easy to talk to. Her office and staff are also great and I never had a hard time reaching her. After a very difficult battle with my ex who was completely unreasonable, Tina was able to negotiate a settlement of my case and she did a fantastic job for me. My life is so much better after this divorce and Tina and her firm had a huge hand in that.

Ladies and gentlemen in the world of fighting legal battles you pay for what you get! If you’re looking to win ( if that’s actually possible in a legal battle) this is the firm you need to be with. I’ve had the pleasure of dealing with my attorney Tammara Grossman , since 2020, steering me through some real legal and monetary issues with my ex-wife. I have found her to be Professional and ethical, guiding me in the correct direction legally even when I didn’t always like it. The end result was about as best for me as you could possibly get. I’m happy.

Tina Lewert instilled in me that there are lawyers in family law that understand unique situations. I had horrible experiences with several lawyers and finding Ms. Lewert was nothing shy of a Godsend. She wholeheartedly understood my situation and was the only lawyer to resolve my 10 year nightmare. I cannot thank Ms. Lewert enough for the freedom she gave me and my son. She has proven to be the absolute best! I highly recommend Tina Lewert, Law for her expertise, honesty and commitment to her clients.

Tina is a wonderful attorney. She guided me through my ugly case and ultimately her wisdom lead me to successful settlement of my case. She wasn’t afraid to advise me of the pros AND cons of my case, and the legal system which can be brutal, and I always felt like she was being straight with me, instead of just telling me what I wanted to hear like another attorney I spoke with. Tina is quick on her feet and I could also tell that she is respected by judges and other attorneys (by the way everyone treated her when we did have to go to court to finalize the divorce once settled). If you need a strong, confident divorce lawyer who also happens to be a good person, hire Tina Lewert.
