Divorce Representation for Delray Beach Residents
Florida is a no-fault divorce state. Neither spouse has to prove wrongdoing to end a marriage. The petition simply states that the marriage is irretrievably broken, and the court proceeds from there under Chapter 61 of the Florida Statutes. That sounds simple on paper. In practice, a divorce case must resolve equitable distribution of your assets and debts, alimony, child support, and a parenting plan if you have children, and each of those issues carries its own legal standards and its own consequences for your future.
Lewert Law is a Boca Raton family law firm that represents clients throughout Palm Beach County, and Delray Beach residents make up a significant part of our practice. Our office sits on Yamato Road in Boca Raton, just south of Delray Beach, and we regularly handle cases for clients from Lake Ida, Pineapple Grove, Tropic Isle, Seagate, Osceola Park, and the neighborhoods along Atlantic Avenue.
Family law matters filed by Delray Beach residents are heard in the Fifteenth Judicial Circuit, and the South County Courthouse at 200 W. Atlantic Avenue, right in downtown Delray Beach, is the venue where local family cases proceed. Ms. Lewert has spent her entire career practicing family law in this circuit. She knows the local procedures, the courthouse, and what the judges here expect from the attorneys who appear before them.
Every divorce is different, and your case strategy should reflect the specifics of your marriage, your finances, and your children. That is why we begin with a careful review of your situation before recommending a path forward, contested or uncontested.
What we handle for Delray Beach clients:
- Contested and uncontested divorce, from filing through final judgment
- High-asset divorce involving businesses, real estate, and complex financial portfolios
- Equitable distribution and the division of assets and liabilities
- Alimony and spousal support, including modifications under Florida’s current alimony law
- Child custody, time-sharing, and parenting plans
- Child support, calculated under Florida’s income shares guidelines
- Post-judgment modifications, contempt, and enforcement

Why Delray Beach Clients Choose Lewert Law
The attorney you hire shapes how your divorce proceedings unfold. Here is what working with our firm actually looks like.
A Board Certified Specialist Handles Your Case
Tina L. Lewert is Board Certified in Marital and Family Law by The Florida Bar, a credential held by only a small fraction of Florida attorneys. Board certification requires substantial trial experience, peer review, and a rigorous examination in this specific field. You can read more about Ms. Lewert’s background and credentials before you ever pick up the phone. When the outcome of the divorce process affects your children and your financial future, certified expertise is not a luxury. It is the point.
Personal Attention From a Deliberately Small Law Group
We keep a small caseload on purpose. When you hire Lewert Law, you work directly with Ms. Lewert and a close-knit team, not a rotating cast of associates. You will not have to re-explain your case to a stranger before every hearing. That personal attention is how details get caught, and details are often where divorce cases are won or lost.
Mediation When Possible, Litigation When Necessary
Ms. Lewert is also a Florida Supreme Court Certified Family Law Mediator, and that perspective shapes our approach. Whenever it serves your interests, we work to resolve matters through negotiation and mediation, because it is usually faster, less costly, and easier on your family. When the other side will not be reasonable, we are fully prepared to litigate assertively at the South County Courthouse or wherever your case is heard.
What to Expect When You Work With a Divorce Lawyer from Lewert Law
1. A Confidential, Collaborative Consultation
We start with a private conversation, usually over Zoom, about your marriage, your concerns, and your goals. You’ll leave with a clear picture of your legal options and an honest assessment of what your case will involve, including fees.
2. Strategy and Filing
Once you retain the firm, we build your case. Florida requires that at least one spouse has lived in the state for six months before filing, and the process formally begins with a petition for dissolution of marriage. We prepare the filings, the financial disclosures, and a strategy matched to your priorities.
3. Negotiation, Mediation, and Discovery
Most Florida divorce cases resolve without a trial. We gather the financial records, value the marital estate, and negotiate from a position of preparation. If mediation is ordered or agreed to, you walk in with a clear plan rather than reacting in the room.
4. Resolution and the Road Ahead
Your case ends either in a marital settlement agreement or a judgment after trial. Either way, we make sure you understand every term before anything is signed, and we remain available afterward for modifications or enforcement if circumstances change.

Tina helped me win a relocation case against “the giant”. A case many insisted was a waste of time because I would never win. Tina is up to date on current statues and case law which lists out certain objectives a relocation must meet in order to be granted. I am amazed by her intelligence and ability to interpret law and break it down to me in an elementary manner. Throughout the case, she was always detail oriented, eloquent, ethical and most of all, Tina possesses a sixth sense of what facts to focus on, what is important for the case. She adequately prepared me and herself for each trial day. I can not say enough praise about this amazing lawyer, hopefully I’ll never need her again, but I wouldn’t complain if I do. Tina and her assistant Sharon treated me like family. They were the light during the worst part of my life. I don’t want to share too much about her strategies but this woman is AMAZING at cross examination. She came up with angles I would have never dreamed of. It’s important to trust Tina, she won’t steer you wrong. Don’t forget, while she fights hard for you, it is also important for you to be diligent as well.

I hired Tina Lewert to represent me in my contentious divorce. I had consulted with several other highly rated divorce lawyers in Boca and she just outshined the others from the moment we first spoke. Highly recommend this lawyer to handle your divorce - don't fall for the others who talk a big talk and try to scare you to stir up the drama which stirs up their fees too. Tina was always honest with me about what I could expect, about the law, and the pros and cons, and she explained the law and how it applied to my case better to me than 3 other [supposedly excellent] lawyers combined. She knows what she's doing but she's not pompous about it and she's easy to talk to. Her office and staff are also great and I never had a hard time reaching her. After a very difficult battle with my ex who was completely unreasonable, Tina was able to negotiate a settlement of my case and she did a fantastic job for me. My life is so much better after this divorce and Tina and her firm had a huge hand in that.

Ladies and gentlemen in the world of fighting legal battles you pay for what you get! If you’re looking to win ( if that’s actually possible in a legal battle) this is the firm you need to be with. I’ve had the pleasure of dealing with my attorney Tammara Grossman , since 2020, steering me through some real legal and monetary issues with my ex-wife. I have found her to be Professional and ethical, guiding me in the correct direction legally even when I didn’t always like it. The end result was about as best for me as you could possibly get. I’m happy.

Tina Lewert instilled in me that there are lawyers in family law that understand unique situations. I had horrible experiences with several lawyers and finding Ms. Lewert was nothing shy of a Godsend. She wholeheartedly understood my situation and was the only lawyer to resolve my 10 year nightmare. I cannot thank Ms. Lewert enough for the freedom she gave me and my son. She has proven to be the absolute best! I highly recommend Tina Lewert, Law for her expertise, honesty and commitment to her clients.

Tina is a wonderful attorney. She guided me through my ugly case and ultimately her wisdom lead me to successful settlement of my case. She wasn’t afraid to advise me of the pros AND cons of my case, and the legal system which can be brutal, and I always felt like she was being straight with me, instead of just telling me what I wanted to hear like another attorney I spoke with. Tina is quick on her feet and I could also tell that she is respected by judges and other attorneys (by the way everyone treated her when we did have to go to court to finalize the divorce once settled). If you need a strong, confident divorce lawyer who also happens to be a good person, hire Tina Lewert.
Common Questions About Divorce in Florida
Do I need grounds to file for divorce in Florida?
No. Florida is a no-fault state, so the only thing you need to state is that the marriage is irretrievably broken. Neither spouse has to prove adultery, abandonment, or any other misconduct to obtain the divorce itself.
How long do I have to live in Florida before I can file?
At least one spouse must have lived in Florida for six months before the petition is filed. Residency is usually shown with a Florida driver's license, a voter registration card, or the testimony of a witness.
How is property divided in a Florida divorce?
Florida uses equitable distribution, which means marital assets and debts are divided fairly, though fair does not always mean an exact 50/50 split. Courts start from the premise of equal division and adjust based on factors like the length of the marriage, each spouse's economic circumstances, and contributions to the marriage, including work as a homemaker.
Does Florida still award permanent alimony?
No. For cases filed on or after July 1, 2023, Florida eliminated permanent alimony. Courts may now award temporary, bridge-the-gap, rehabilitative, or durational alimony, each with limits on amount and duration tied to the length of the marriage and the finances of both spouses.
How do Florida courts decide child custody and time-sharing?
Every decision comes down to the best interests of the child. Since 2023, Florida law also applies a rebuttable presumption that equal time-sharing serves the child's best interests, though a court can order a different schedule when the evidence supports it. A detailed parenting plan governs child custody and time-sharing after the divorce.
