When the marital estate is large, divorce becomes more than a legal matter. It is the division of a business, a portfolio, a retirement strategy, often a home, and the privacy you have built around all of them. Working with a Palm Beach Gardens divorce lawyer who is a board certified family law attorney in Boca Raton, Board Certified in Marital and Family Law by The Florida Bar, can help protect your interests and make sure the terms of your divorce are handled the way they need to be.
Most people facing a high-asset divorce are unfamiliar with how Florida law actually divides complex marital estates, and uncertainty at this stage adds real stress. It is important to have a Palm Beach Gardens divorce attorney with a solid understanding of Florida’s divorce laws, procedures, and the local courts. High-Asset and Complex Divorce Representation
Tina L. Lewert is Board Certified in Marital and Family Law by The Florida Bar, a designation only a small percentage of Florida family lawyers hold. She has the experience and the in-depth knowledge of Florida law to handle complex marital estates, including the issues that come up most often in high-asset cases. Ms. Lewert is also a Florida Supreme Court Certified Family Law Mediator, which means she can help guide negotiated settlements outside of court when the terms can be fair to both sides.
A high-asset divorce is rarely just a larger version of a regular one. The work is structurally different. There is often a business to value, retirement accounts and deferred compensation that are not divided the way liquid assets are, premarital and inherited property to trace, and a real need for the entire process to stay out of view of employees, clients, or the public record where possible. We coordinate with forensic accountants, business valuation experts, and financial planners where the case calls for it.
For Palm Beach Gardens clients specifically, the local court reality matters. Most Palm Beach Gardens family files are heard at the North County Courthouse at 3188 PGA Boulevard, the northern branch of the 15th Judicial Circuit of Florida. Complex matters and contested cases may be moved to the Main Courthouse in West Palm Beach. Knowing the local procedure, the judges, and the mediation roster matters in high-asset cases more than in most, because the choices about how to sequence the case hinge on local practice as much as on the statute.
Lewert Law handles a variety of high-asset family law matters, including:
- Equitable distribution of complex marital estates
- Retirement, deferred compensation, and stock option division
- Premarital, inherited, and traceable separate property
- Real estate and investment property division
- High-conflict and contested high-asset divorce
- Mediation for parties with significant assets
- Post-judgment modifications to complex final judgments
Tina L. Lewert can help you move forward, regardless of how complex the financial picture is. To schedule your confidential consultation, contact Lewert Law, LLC by calling (561) 544-6861.
Palm Beach Gardens High-Asset Divorce: Common Questions
A high-asset divorce can be a complicated process, and what you do not know can cost you. Understanding what to expect helps you make better decisions at every stage. Here are some of the questions we hear most often from prospective clients in Palm Beach Gardens.
How is a business valued in a Florida divorce?
A business owned by one or both spouses is typically valued by a qualified business valuation expert, often a CPA with an Accredited in Business Valuation (ABV) or Certified Valuation Analyst (CVA) credential. The valuation generally considers the business's earnings, comparable market sales, and asset values, depending on the type of business. In contested cases, each side may retain its own expert, and the court decides how to weigh competing valuations.
The way the business interest is then divided depends on whether the business is marital property, separate property, or partly each, and on what other assets are available to offset the value if the operator spouse keeps the business.
How are retirement accounts and 401(k)s divided?
Retirement accounts accumulated during the marriage are generally considered marital property subject to equitable distribution, regardless of whose name is on the account. The portion earned before the marriage is typically separate property. Dividing tax-qualified retirement accounts usually requires a Qualified Domestic Relations Order (QDRO), a separate court order that tells the plan administrator how to split the account without triggering early-withdrawal penalties or taxes. The mechanics of QDROs are technical, and getting them right matters.
What is the difference between marital and separate property?
In Florida, marital property generally means assets and debts acquired during the marriage. Separate property generally means assets either spouse owned before the marriage, inheritances, gifts to one spouse, and certain other categories. Separate property is not subject to equitable distribution.
The complications arise when separate property has been commingled with marital property, or when one spouse claims the increase in value of separate property is itself a marital asset. Tracing these distinctions is one of the more technical pieces of a high-asset divorce.
How is alimony decided in a high-income Florida divorce?
Florida's alimony law was significantly revised in 2023. Permanent alimony has been eliminated for final judgments entered on or after July 1, 2023. The current law allows four types: temporary, bridge-the-gap, rehabilitative, and durational. Durational alimony is capped at 50% of the length of a short-term marriage, 60% of a moderate-term marriage, and 75% of a long-term marriage, and the amount is generally capped at the lesser of the recipient's reasonable need or 35% of the difference between the parties' net incomes.
In high-income cases, the calculations get more complex when bonus income, deferred compensation, business distributions, and standard of living all factor in.
How is a high-asset divorce kept private?
Florida court filings are generally public record, which is a real concern for clients who prefer to keep their financial affairs out of public view. Several tools can help: financial information can often be filed under seal in specific circumstances, settlement agreements can be structured to keep terms confidential, and mediation keeps the substantive negotiations out of the public courtroom in the first place.
There are limits to what can be sealed in Florida, and the strategy must comply with public records law, but there is meaningful room to manage what becomes part of the public record and what does not. This is a conversation worth having at the start of the case.

Tina helped me win a relocation case against “the giant”. A case many insisted was a waste of time because I would never win. Tina is up to date on current statues and case law which lists out certain objectives a relocation must meet in order to be granted. I am amazed by her intelligence and ability to interpret law and break it down to me in an elementary manner. Throughout the case, she was always detail oriented, eloquent, ethical and most of all, Tina possesses a sixth sense of what facts to focus on, what is important for the case. She adequately prepared me and herself for each trial day. I can not say enough praise about this amazing lawyer, hopefully I’ll never need her again, but I wouldn’t complain if I do. Tina and her assistant Sharon treated me like family. They were the light during the worst part of my life. I don’t want to share too much about her strategies but this woman is AMAZING at cross examination. She came up with angles I would have never dreamed of. It’s important to trust Tina, she won’t steer you wrong. Don’t forget, while she fights hard for you, it is also important for you to be diligent as well.

I hired Tina Lewert to represent me in my contentious divorce. I had consulted with several other highly rated divorce lawyers in Boca and she just outshined the others from the moment we first spoke. Highly recommend this lawyer to handle your divorce - don't fall for the others who talk a big talk and try to scare you to stir up the drama which stirs up their fees too. Tina was always honest with me about what I could expect, about the law, and the pros and cons, and she explained the law and how it applied to my case better to me than 3 other [supposedly excellent] lawyers combined. She knows what she's doing but she's not pompous about it and she's easy to talk to. Her office and staff are also great and I never had a hard time reaching her. After a very difficult battle with my ex who was completely unreasonable, Tina was able to negotiate a settlement of my case and she did a fantastic job for me. My life is so much better after this divorce and Tina and her firm had a huge hand in that.

Ladies and gentlemen in the world of fighting legal battles you pay for what you get! If you’re looking to win ( if that’s actually possible in a legal battle) this is the firm you need to be with. I’ve had the pleasure of dealing with my attorney Tammara Grossman , since 2020, steering me through some real legal and monetary issues with my ex-wife. I have found her to be Professional and ethical, guiding me in the correct direction legally even when I didn’t always like it. The end result was about as best for me as you could possibly get. I’m happy.

Tina Lewert instilled in me that there are lawyers in family law that understand unique situations. I had horrible experiences with several lawyers and finding Ms. Lewert was nothing shy of a Godsend. She wholeheartedly understood my situation and was the only lawyer to resolve my 10 year nightmare. I cannot thank Ms. Lewert enough for the freedom she gave me and my son. She has proven to be the absolute best! I highly recommend Tina Lewert, Law for her expertise, honesty and commitment to her clients.

Tina is a wonderful attorney. She guided me through my ugly case and ultimately her wisdom lead me to successful settlement of my case. She wasn’t afraid to advise me of the pros AND cons of my case, and the legal system which can be brutal, and I always felt like she was being straight with me, instead of just telling me what I wanted to hear like another attorney I spoke with. Tina is quick on her feet and I could also tell that she is respected by judges and other attorneys (by the way everyone treated her when we did have to go to court to finalize the divorce once settled). If you need a strong, confident divorce lawyer who also happens to be a good person, hire Tina Lewert.
