Palm Beach Gardens Child Support Attorney
Child support is supposed to be a formula, but the numbers that go into the formula are where cases are won and lost. Income that is understated, overnights that are miscounted, and expenses that are missed can change the result by hundreds of dollars a month, every month, for years. A child support lawyer serving Palm Beach Gardens makes sure the calculation reflects your family’s real numbers.

Child Support Lawyer in Palm Beach Gardens, FL
Lewert Law is a family law firm based in Boca Raton that handles child support matters for parents throughout Palm Beach County, including Palm Beach Gardens and communities like PGA National, Evergrene, Mirasol, and BallenIsles. Ms. Lewert works on both sides of these cases, for parents who will pay support and parents who will receive it, in divorce cases, paternity actions, and standalone support proceedings.
Florida calculates child support under Section 61.30 of the Florida Statutes using an income shares model. Both parents’ net monthly incomes are combined, a statutory schedule sets the basic support amount for that combined income and the number of children, and each parent is responsible for a share proportional to their income. Health insurance premiums for the child and work-related childcare costs are added on top and divided proportionally as well.
Time-sharing changes the math. When a parent has the child for at least 20 percent of the overnights in a year, roughly 73 nights, Florida applies a gross-up formula that adjusts each parent’s obligation based on the actual overnight split. The count matters precisely, which is one reason your parenting plan and your support order should be built together rather than in isolation.
The formula sounds mechanical, and for two W-2 employees it often is. It stops being mechanical when a parent is self-employed, earns bonuses or commissions, holds investment or rental income, or is capable of earning more than they currently report. Florida law defines income broadly, and courts can impute income to a parent who is voluntarily earning less. In the country club communities of Palm Beach Gardens, those income questions come up constantly, and they are exactly where experienced counsel earns its keep. Family division hearings for north county cases are generally held at the North County Courthouse at 3188 PGA Boulevard, with some matters handled at the Main Courthouse in West Palm Beach.
Our Palm Beach Gardens child support practice handles:
- Initial child support calculations in divorce and paternity cases
- Support involving self-employment, bonus, and investment income
- Imputed income disputes
- Modification of existing support orders
- Enforcement when a parent does not pay
- Support adjustments tied to time-sharing changes
- Guideline deviation arguments

Why Hire Lewert Law for Your Child Support Case
When it comes to issues like alimony and custody, intervention and mediation only work out as well as the strategy behind them are sound. Getting a petition right takes more than general legal guidance.
A Board Certified Specialist on the Numbers
Tina L. Lewert is Board Certified in Marital and Family Law by The Florida Bar, a designation held since 2009 by an attorney who works with the support guidelines every week. She knows where incomes hide, how deductions are misused, and which deviation arguments courts actually accept.
Both Sides of the Worksheet
Ms. Lewert represents paying parents who need the order to reflect reality and receiving parents who need support their children can rely on. Seeing these cases from both chairs means she can anticipate the other side’s arguments before they are made.
Support and Time-Sharing, Handled Together
Because overnights directly affect the support calculation, your parenting plan and your support order are two halves of one outcome. As a firm that practices marital and family law exclusively, we build them together so neither undercuts the other.
What to Expect in a Palm Beach County Child Support Case
- Confidential consultation. We review your income picture, the other parent’s income picture as you understand it, and your time-sharing arrangement, then walk you through what the guidelines would likely produce and where the pressure points are.
- Financial disclosure. Both parents exchange financial affidavits and supporting documents. When a parent’s reported income does not match their lifestyle, this is where we dig in, with discovery tools that reach beyond the affidavit.
- Calculation and negotiation. We prepare an accurate guideline worksheet and negotiate from it. Many support disputes resolve once the numbers are documented and both sides see what a judge would likely order.
- Hearing and order. If agreement is not possible, the court hears the evidence and enters a support order. We present the documentation, the testimony, and, where needed, the deviation arguments that support the right result.
Modifying or Ending Alimony After Divorce
Circumstances change after a divorce, and Florida law recognizes that. As a post-dissolution alimony attorney Boca Raton clients rely on, Tina L. Lewert handles requests to modify or terminate support under Florida Statute 61.14.
Whether alimony can be changed depends on the type. Bridge-the-gap alimony is not modifiable. Rehabilitative and durational alimony may be modified when there is a substantial change in circumstances, such as a significant change in income, a job loss, or the paying spouse’s good-faith retirement. Most forms of alimony terminate automatically if the recipient remarries or either party dies, and support may also be reduced or ended if the recipient enters a supportive relationship, meaning a cohabitation arrangement that provides financial support similar to a marriage. If your former spouse has stopped paying as ordered, we can ask the court to enforce the order, and the paying party may be held in contempt.
Why Work With a Board Certified Boca Raton Alimony Lawyer
Spousal support sits at the intersection of family law and finance, and the rules have shifted meaningfully since 2023. Working with a board-certified specialist means your case is handled by someone whose focus and experience in marital and family law have been formally recognized by The Florida Bar. Because Lewert Law keeps a deliberately limited caseload, the attorney you meet is the attorney who handles your matter.
That certified focus has been recognized by The Florida Bar and the wider legal profession:

Tina helped me win a relocation case against “the giant”. A case many insisted was a waste of time because I would never win. Tina is up to date on current statues and case law which lists out certain objectives a relocation must meet in order to be granted. I am amazed by her intelligence and ability to interpret law and break it down to me in an elementary manner. Throughout the case, she was always detail oriented, eloquent, ethical and most of all, Tina possesses a sixth sense of what facts to focus on, what is important for the case. She adequately prepared me and herself for each trial day. I can not say enough praise about this amazing lawyer, hopefully I’ll never need her again, but I wouldn’t complain if I do. Tina and her assistant Sharon treated me like family. They were the light during the worst part of my life. I don’t want to share too much about her strategies but this woman is AMAZING at cross examination. She came up with angles I would have never dreamed of. It’s important to trust Tina, she won’t steer you wrong. Don’t forget, while she fights hard for you, it is also important for you to be diligent as well.

I hired Tina Lewert to represent me in my contentious divorce. I had consulted with several other highly rated divorce lawyers in Boca and she just outshined the others from the moment we first spoke. Highly recommend this lawyer to handle your divorce - don't fall for the others who talk a big talk and try to scare you to stir up the drama which stirs up their fees too. Tina was always honest with me about what I could expect, about the law, and the pros and cons, and she explained the law and how it applied to my case better to me than 3 other [supposedly excellent] lawyers combined. She knows what she's doing but she's not pompous about it and she's easy to talk to. Her office and staff are also great and I never had a hard time reaching her. After a very difficult battle with my ex who was completely unreasonable, Tina was able to negotiate a settlement of my case and she did a fantastic job for me. My life is so much better after this divorce and Tina and her firm had a huge hand in that.

Ladies and gentlemen in the world of fighting legal battles you pay for what you get! If you’re looking to win ( if that’s actually possible in a legal battle) this is the firm you need to be with. I’ve had the pleasure of dealing with my attorney Tammara Grossman , since 2020, steering me through some real legal and monetary issues with my ex-wife. I have found her to be Professional and ethical, guiding me in the correct direction legally even when I didn’t always like it. The end result was about as best for me as you could possibly get. I’m happy.

Tina Lewert instilled in me that there are lawyers in family law that understand unique situations. I had horrible experiences with several lawyers and finding Ms. Lewert was nothing shy of a Godsend. She wholeheartedly understood my situation and was the only lawyer to resolve my 10 year nightmare. I cannot thank Ms. Lewert enough for the freedom she gave me and my son. She has proven to be the absolute best! I highly recommend Tina Lewert, Law for her expertise, honesty and commitment to her clients.

Tina is a wonderful attorney. She guided me through my ugly case and ultimately her wisdom lead me to successful settlement of my case. She wasn’t afraid to advise me of the pros AND cons of my case, and the legal system which can be brutal, and I always felt like she was being straight with me, instead of just telling me what I wanted to hear like another attorney I spoke with. Tina is quick on her feet and I could also tell that she is respected by judges and other attorneys (by the way everyone treated her when we did have to go to court to finalize the divorce once settled). If you need a strong, confident divorce lawyer who also happens to be a good person, hire Tina Lewert.
Frequently Asked Questions
How is child support calculated in the Florida legal system?
Florida uses an income shares model under Section 61.30 of the Florida Statutes. Both parents' net monthly incomes are combined, a statutory schedule sets the basic obligation for that income level and number of children, and each parent pays a share proportional to their income, with health insurance and childcare costs added and divided the same way.
Does equal time-sharing mean no one pays child support?
Usually not. With a 50/50 schedule, the time-sharing adjustment reduces the transfer between homes, but when one parent earns more, that parent typically still pays some support. The formula accounts for both the overnight split and the income difference.
What counts as income for child support?
A divorce can take
Florida defines income broadly. It includes salary and wages, bonuses and commissions, self-employment earnings, rental income, and investment returns, among other sources. Courts can also impute income to a parent who is voluntarily unemployed or underemployed, based on what that parent could reasonably earn.
months, especially if it is contested. Because of that, Florida allows a spouse to request temporary alimony, which is support awarded while the divorce is still in progress. Temporary support can often be obtained relatively early in the case, easing financial pressure while the rest of the divorce is worked out.
Can child support be changed after the order is entered?
Yes. A support order can be modified when there is a substantial change in circumstances, such as a significant change in either parent's income or a lasting change in the time-sharing schedule. As a practical benchmark, courts look for a meaningful gap between the existing order and what the guidelines would produce today.
What happens to the schedule if the combined income is very high?
The statutory schedule runs to a combined net income of $10,000 per month. Above that level, the obligation is the top schedule amount plus a statutory percentage of the income over $10,000, which varies with the number of children. High-income cases also tend to raise deviation and needs-based arguments that deserve careful handling.
What can I do if the other parent will not pay in a divorce settlement?
Florida gives courts real enforcement power over unpaid support, and a parent who ignores an order can face serious consequences. The right tool depends on your situation, and we can pursue enforcement so the support your child is owed actually arrives.
