Under Section 61.08 of the Florida Statutes, every alimony case starts with two findings: one spouse’s actual need for support, and the other spouse’s ability to pay. Only after both are established does the court decide the type, amount, and length of an alimony award, guided by factors that include the duration of the marriage, the standard of living the couple maintained, the age and health of each spouse, and what each contributed, financially and otherwise.
Florida now recognizes four forms of alimony. Temporary alimony supports a spouse while the case is pending. Bridge-the-gap alimony covers short-term, identifiable needs in the transition to single life and cannot exceed two years. Rehabilitative alimony funds a defined plan to rebuild earning capacity, such as finishing a degree or recertifying in a profession, and is capped at five years. Durational alimony provides support for a set period tied to the length of the marriage. Permanent alimony no longer exists for cases filed on or after July 1, 2023.
