Florida no longer uses the word “custody” in its statutes. The law speaks instead of parental responsibility, which covers decision-making about education, healthcare, and upbringing, and time-sharing, which is the schedule of when the child is with each parent. Both are set out in a parenting plan, and every determination comes down to one standard under Section 61.13 of the Florida Statutes: the best interests of the child.
Since 2023, Florida law has also applied a rebuttable presumption that equal time-sharing is in a child’s best interests. That presumption is a starting point, not a finish line.
