Divorce Representation for West Palm Beach, Florida

Lewert Law is a divorce and family law firm based in Boca Raton that represents clients throughout Palm Beach County, including West Palm Beach and its neighborhoods from Northwood and Flamingo Park to El Cid, Grandview Heights, and the South of Southern corridor. We keep our caseload deliberately small so that Ms. Lewert, not a rotating cast of junior staff, handles your case personally. She works to resolve matters through mediation and negotiation whenever that serves your interests, and she litigates with professionalism when the other side will not be reasonable.

Florida calls divorce a dissolution of marriage, and the ground rules are set by Chapter 61 of the Florida Statutes. Florida is a no-fault state, which means neither spouse has to prove wrongdoing. The court only needs to find that the marriage is irretrievably broken. Before you can file, at least one spouse must have lived in Florida for the six months immediately before the petition, and a final judgment cannot be entered until at least 20 days after filing.

For West Palm Beach residents, divorce cases are filed with the Palm Beach County Clerk of the Circuit Court and are generally heard in the family division of the Fifteenth Judicial Circuit at the Main Courthouse, the Judge Daniel T. K. Hurley Courthouse at 205 North Dixie Highway in downtown West Palm Beach. Because the courthouse sits in your own city, hearings and filings for West Palm Beach cases run through the county seat rather than a satellite location, and knowing how that courthouse operates matters when deadlines and hearing schedules start to stack up.

Why Hire Lewert Law for Your West Palm Beach Divorce

The lawyer you choose shapes how your divorce unfolds, so it is worth knowing what sets Lewert Law apart.

Board Certified in Marital and Family Law

The Florida Bar formally recognizes attorneys who demonstrate special knowledge, skill, and proficiency in a practice area. Tina L. Lewert has held Board Certification in Marital and Family Law since 2009, and only a small minority of Florida family lawyers earn the designation. You are not hiring a generalist who also takes divorce cases. You are hiring a specialist certified by The Florida Bar in exactly this area of law.

Personal Attention, By Design

Lewert Law maintains a small caseload on purpose. The family law attorney you meet at your consultation is the attorney who develops your strategy, negotiates on your behalf, and stands next to you in court. When your divorce involves your children, your home, and your financial future, that continuity is not a luxury. It is how careful work gets done.

Resolution First, Trial When Necessary

As a Florida Supreme Court Certified Family Law Mediator, Ms. Lewert understands settlement from both chairs. Whenever it serves your interests, she works to resolve every family law matter through mediation and negotiation, which is usually faster, less costly, and less damaging to the people involved. When what is fair is on the line and the other side will not move, she is fully prepared to try the case.

What to Expect in the Florida Divorce Process

  1. Confidential consultation. At our law firm, we start with a private conversation about your situation. You will leave with a realistic picture of your options, the process ahead, and what your case will require. Fees are discussed openly here, so you can make an informed decision before committing to anything.
  2. Filing and financial disclosure. One spouse files a Petition for Dissolution of Marriage with the Palm Beach County Clerk of the Circuit Court. Both spouses then exchange mandatory financial disclosures, including a financial affidavit, so that property, debts, and income are on the table.
  3. Negotiation and mediation. Most Florida divorce cases settle before trial. We work toward agreement on property division, time-sharing, and support, and Palm Beach County courts generally require mediation before a contested case proceeds to a final hearing.
  4. Resolution or trial. If you reach a full agreement, the court incorporates it into a final judgment. If issues remain contested, Ms. Lewert and her law office present your case to the judge and advocate to protect your rights through trial.

Tina helped me win a relocation case against “the giant”. A case many insisted was a waste of time because I would never win. Tina is up to date on current statues and case law which lists out certain objectives a relocation must meet in order to be granted. I am amazed by her intelligence and ability to interpret law and break it down to me in an elementary manner. Throughout the case, she was always detail oriented, eloquent, ethical and most of all, Tina possesses a sixth sense of what facts to focus on, what is important for the case. She adequately prepared me and herself for each trial day. I can not say enough praise about this amazing lawyer, hopefully I’ll never need her again, but I wouldn’t complain if I do. Tina and her assistant Sharon treated me like family. They were the light during the worst part of my life. I don’t want to share too much about her strategies but this woman is AMAZING at cross examination. She came up with angles I would have never dreamed of. It’s important to trust Tina, she won’t steer you wrong. Don’t forget, while she fights hard for you, it is also important for you to be diligent as well.

I hired Tina Lewert to represent me in my contentious divorce. I had consulted with several other highly rated divorce lawyers in Boca and she just outshined the others from the moment we first spoke. Highly recommend this lawyer to handle your divorce - don't fall for the others who talk a big talk and try to scare you to stir up the drama which stirs up their fees too. Tina was always honest with me about what I could expect, about the law, and the pros and cons, and she explained the law and how it applied to my case better to me than 3 other [supposedly excellent] lawyers combined. She knows what she's doing but she's not pompous about it and she's easy to talk to. Her office and staff are also great and I never had a hard time reaching her. After a very difficult battle with my ex who was completely unreasonable, Tina was able to negotiate a settlement of my case and she did a fantastic job for me. My life is so much better after this divorce and Tina and her firm had a huge hand in that.

Ladies and gentlemen in the world of fighting legal battles you pay for what you get! If you’re looking to win ( if that’s actually possible in a legal battle) this is the firm you need to be with. I’ve had the pleasure of dealing with my attorney Tammara Grossman , since 2020, steering me through some real legal and monetary issues with my ex-wife. I have found her to be Professional and ethical, guiding me in the correct direction legally even when I didn’t always like it. The end result was about as best for me as you could possibly get. I’m happy.

Tina Lewert instilled in me that there are lawyers in family law that understand unique situations. I had horrible experiences with several lawyers and finding Ms. Lewert was nothing shy of a Godsend. She wholeheartedly understood my situation and was the only lawyer to resolve my 10 year nightmare. I cannot thank Ms. Lewert enough for the freedom she gave me and my son. She has proven to be the absolute best! I highly recommend Tina Lewert, Law for her expertise, honesty and commitment to her clients.

Tina is a wonderful attorney. She guided me through my ugly case and ultimately her wisdom lead me to successful settlement of my case. She wasn’t afraid to advise me of the pros AND cons of my case, and the legal system which can be brutal, and I always felt like she was being straight with me, instead of just telling me what I wanted to hear like another attorney I spoke with. Tina is quick on her feet and I could also tell that she is respected by judges and other attorneys (by the way everyone treated her when we did have to go to court to finalize the divorce once settled). If you need a strong, confident divorce lawyer who also happens to be a good person, hire Tina Lewert.

Frequently Asked Questions

How long does a divorce take in Florida?

It depends mostly on whether your divorce is contested. Florida law imposes a 20-day minimum between filing and final judgment, and an uncontested divorce can sometimes be finalized within weeks once the paperwork is complete. A contested case that needs a judge to decide custody or property issues typically takes several months or longer, depending on complexity and the court's schedule.

Do I have to live in Florida to file for divorce in West Palm Beach?

At least one spouse must have been a Florida resident for the six months immediately before filing, under Section 61.021 of the Florida Statutes. Residency is commonly proven with a Florida driver's license, a voter registration card, or witness testimony. Either spouse can satisfy the requirement.

Where will my West Palm Beach divorce case be heard?

Divorce cases for West Palm Beach are filed with the Palm Beach County Clerk of the Circuit Court and are generally heard in the family division of the Fifteenth Judicial Circuit at the Main Courthouse, 205 North Dixie Highway in West Palm Beach. We appear in Palm Beach County's family courts regularly and can confirm the correct venue for your case.

Do I need to prove my spouse did something wrong?

No. Florida is a no-fault divorce state, so the only ground you need is that the marriage is irretrievably broken. Fault generally does not affect the divorce itself, though financial misconduct, such as wasting marital assets, can influence how property and support issues are decided.

How is property divided in a Florida divorce?

Florida uses equitable distribution under Section 61.075 of the Florida Statutes, which means marital property is divided fairly, though fair does not always mean an exact 50/50 split. The court weighs factors like the length of the marriage, each spouse's contributions, and each spouse's economic circumstances. Assets owned before the marriage generally remain separate property.

How will divorce affect time-sharing with my children?

Since July 2023, Florida law starts from a rebuttable presumption that equal time-sharing is in a child's best interests, but the presumption can be overcome and courts still weigh the statutory best-interest factors in every case. A well-constructed parenting plan addresses the schedule, decision-making, and how the two of you will communicate going forward.
