Florida law no longer uses the word custody the way most parents do. Since July 2023, Florida law has started from a rebuttable presumption that equal time-sharing is in a child’s best interests. That presumption is only a starting point. Courts still weigh the statutory best-interest factors in every case, including each parent’s ability to support the child’s relationship with the other parent, the stability of each home, and, when the child is mature enough, the child’s own preference.
